1. About these terms

In these terms, “we”, “us” and “our” mean Bsurv Ltd (company number 13506684). “You” means the person using this website or instructing us to provide services. These terms apply to use of our website and to enquiries and services unless we agree different terms in writing for a specific job.

2. Services

We provide building surveying, architectural design and related consultancy services. We will confirm the scope, deliverables and any key assumptions in writing, usually within a proposal, appointment letter or email.

Any guidance on this website is general information. You should not rely on it as professional advice for a specific property or project without instructing us.

3. Quotes and instructions

Quotes are based on the information you provide at the time. If scope changes, site conditions differ from what was described, or access is restricted, we may need to revise the fee or timescale. We will confirm any change before continuing where possible.

You confirm that you have authority to instruct us and to allow us access to the property or relevant documents. If you instruct us on behalf of a third party, you remain responsible for payment unless we agree otherwise in writing.

4. Timescales and access

We will agree a proposed timescale once we have the required information and access. Timescales depend on availability, access arrangements, weather, third party responses and the complexity of the site.

You are responsible for arranging access, including permissions, keys, alarms, escorts and any site induction requirements. If access is missed or delayed, we may charge reasonable additional costs.

5. Fees and payment

Our fees will be set out in writing. Unless stated otherwise, invoices are payable within 30 days. We may request a deposit before booking site time or starting work.

If an invoice becomes overdue, we may pause work until payment is received. We may charge statutory interest and reasonable recovery costs where applicable.

6. Changes and cancellation

If you need to change an appointment, please give as much notice as possible. If you cancel with short notice after we have booked site time, travel or subcontractors, you may need to pay reasonable costs already incurred.

If we need to cancel due to illness, safety concerns, access issues or events outside our control, we will rearrange as soon as possible. If rearrangement is not possible, we will refund fees paid for work not yet carried out.

7. Reports, reliance and third parties

Our reports and deliverables are prepared for the named client and for the stated purpose. They are based on the agreed scope, the information available, and what could reasonably be inspected at the time.

You must not provide our report to third parties for reliance without our written consent. If a lender, purchaser, tenant, contractor or other party needs to rely on the report, we may offer a reliance letter on agreed terms and fees.

We may recommend further investigations by specialists, for example structural engineers, asbestos surveyors, drainage specialists or fire engineers. Any third party appointment is between you and the specialist unless we agree to manage it in writing.

8. Website use

You may use this website for lawful purposes only. You must not attempt to gain unauthorised access, introduce malware, or interfere with the site’s operation.

We may update, suspend or withdraw parts of the website without notice. We do not guarantee that the website will always be available.

9. Intellectual property

We own or license the intellectual property rights in this website, including text, graphics and branding. You may view and print pages for your own use, but you must not copy, reproduce or republish content without our written permission.

10. Links to other sites

This website may include links to third party websites. We do not control those sites and we are not responsible for their content, policies or availability.

11. Liability

Nothing in these terms limits or excludes liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or fraud.

Subject to the paragraph above, we are not liable for losses that are not reasonably foreseeable, losses caused by events outside our control, or losses arising from misuse of a report outside its stated scope or purpose.

Any services will be provided with reasonable care and skill. Where we agree a written appointment for a job, that document may include additional limitations and will take precedence if it conflicts with these website terms.

12. Complaints

If you are unhappy with our service, please contact us first so we can try to resolve the issue quickly. If you want to make a formal complaint, email info@bsurv.co.uk with details of the job, dates, and what outcome you are seeking.

13. Governing law

These terms are governed by the laws of England and Wales. The courts of England and Wales will have exclusive jurisdiction.

14. Contact

If you have any questions about these terms, contact us at info@bsurv.co.uk or call 07809 365510.
